Precautionary Protection of Eligibility Provisions in Iraqi Traffic Law: An Analytical Study

الملخص

This research centers on the concept of Precautionary Protection as a preventive legislative strategy within Iraqi Traffic Law, aiming to ensure road safety through the rigorous screening of driver's license applicants. This protection is grounded in the concept of "Special Eligibility," which transcends traditional civil criteria to encompass physical fitness, psychological competence, and legal compliance.

The study examines the role of legislative disqualifications in excluding unfit categories, with a specific focus on the regulatory loopholes associated with "Temporary Licenses." Consequently, the research presents reformatory proposals for the Iraqi legislator, highlighting two primary pillars: first, stiffening administrative penalties for the misuse of temporary licenses to include permanent revocation; and second, imposing legal restrictions on driving after the age of seventy to mitigate the risks associated with natural physical and mental decline. These proposals are driven by the overarching legal principle of prioritizing the protection of human lives and public property.
